Court of Justice of the European Union ruling clarifies cookies consent requirements
Importantly, with this decision, the CJEU established that consent cannot validly be obtained through the use of pre-checked boxes. The ruling resolves several specific questions about how consent can be validly obtained under the current EU data protection regime, including both the ePrivacy Directive and the EU General Data Protection Regulation.
